These Terms & Conditions ("Terms") apply to your use of the Built By Flook website at builtbyflook.com and to any enquiry you make through it. If you go on to take a plan, the Service Agreement also applies. By using this website you accept these Terms.

01 Who we are
This website is operated by Built By Flook, a web design business run by Alfie Flook, based in Williamstown, Victoria, Australia. In these Terms, "we", "us" and "our" mean Built By Flook, and "you" means the person using the website.
02 Using this website
You may use this website for lawful purposes — to learn about the services, view examples of work, and get in touch. You agree not to misuse the site, interfere with its operation, attempt to gain unauthorised access, or use it in any way that breaks the law or infringes someone else's rights.
03 Enquiries & free mock-ups
Getting in touch or requesting a free mock-up doesn't create a binding contract — it simply starts a conversation. Any quote or mock-up I provide is an invitation to proceed, not an offer you can accept to force a contract.
Mock-ups remain the property of Built By Flook. A mock-up or preview I share with you is a sample created to show a possible design. It is provided for your review only and may carry preview branding or watermarks. You may not publish, reuse, copy, or pass a mock-up to another developer to reproduce. Ownership of a build only ever passes as described in the Service Agreement.
04 Services
Built By Flook provides custom-coded websites on monthly plans, including hosting, domain and SSL management, and ongoing updates. The full terms of those services — pricing, changes, intellectual property, cancellation and more — are set out in the Service Agreement, which takes effect when you start a plan. Where these Terms and the Service Agreement differ in relation to the paid services, the Service Agreement applies.
05 Intellectual property
Unless stated otherwise, everything on this website — the design, code, text, graphics, and the "Built By Flook" name and branding — is owned by Built By Flook and protected by intellectual property laws. You may view and share links to the site, but you may not copy, reproduce, or reuse its code or design without written permission.
Logos and brand names of clients shown in examples of work belong to their respective owners and are shown for illustration.
06 Acceptable use
When contacting us or submitting anything through the site, you agree not to send unlawful, misleading, abusive, or infringing content, and not to transmit spam, malware, or anything designed to harm the site or its users.
07 Third-party links
This site may link to other websites (for example, live client sites or tools). Those sites are not under our control, and we're not responsible for their content, accuracy, or practices. A link isn't an endorsement.
08 Disclaimers
The information on this website is provided in good faith and for general information only. While I keep it as accurate and current as I reasonably can, I don't warrant that it is complete, error-free, or up to date, and it shouldn't be relied on as professional advice. Pricing shown is indicative and may change.
09 Liability
Nothing in these Terms excludes or limits any rights you have under the Australian Consumer Law that cannot lawfully be excluded.
To the extent permitted by law, Built By Flook is not liable for any loss or damage arising from your use of, or inability to use, this website, including indirect or consequential loss. Where liability can be limited, it is limited to re-supplying the relevant service or paying the cost of doing so.
10 Privacy
How we handle the information you give us — for example through the contact form — is explained in our Privacy Policy. By using the site and contacting us, you agree to that Policy.
11 Changes to these Terms
We may update these Terms from time to time. The current version is always the one published on this page, with the "last updated" date at the top. Continuing to use the site after a change means you accept the updated Terms.
12 Governing law
These Terms are governed by the laws of Victoria, Australia. Any dispute is subject to the non-exclusive jurisdiction of the courts of that State.
